These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and FreeForge LLC, a Wyoming limited liability company ("we," "us," "our," "Company," "FastRender.ai").

BY ACCESSING OR USING FASTRENDER.AI, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICE.

1. Acceptance of Terms

1.1 Binding Agreement

By creating an account, accessing, or using any part of FastRender.ai (including our website, web application, Rhino 3D plugin, Studio features, or API), you acknowledge that you have read, understood, and agree to be bound by:

  • These Terms of Service
  • Our Privacy Policy
  • Any additional terms, guidelines, or policies incorporated by reference

1.2 Modifications to Terms

Right to Modify:

  • We reserve the right to modify these Terms at any time
  • Material changes will be communicated via email to your registered email address
  • Continued use after notification constitutes acceptance of updated Terms

User Obligation:

  • You are responsible for reviewing Terms periodically
  • We will update the "Last Updated" date at the bottom of this document
  • If you do not agree to modified Terms, you must stop using our Service

1.3 Additional Terms

Certain features or services may be subject to additional terms and conditions, which will be presented to you at the time of use. Those additional terms are incorporated into these Terms by reference.

2. Service Description

2.1 What FastRender.ai Provides

FastRender.ai is an AI-powered Software-as-a-Service (SaaS) platform that enables architects, interior designers, and other professionals to generate high-quality architectural renders using artificial intelligence.

Core Services:

  • Rhino 3D Plugin: Desktop plugin for McNeel Rhino 3D software that captures 3D model snapshots
  • AI Render Generation: Conversion of 3D snapshots and user prompts into photorealistic renders using AI
  • Web Application: Browser-based interface to view, manage, and download generated renders
  • Studio Features: Advanced AI tools for refining, upscaling, and enhancing generated renders
  • Image Storage: Cloud storage for your generated renders

2.2 AI Services

Primary AI Service:

Google Gemini 2.5 Flash API for image generation

Future AI Services (Subject to Availability):

  • Additional image generation models (Runway, Stability AI, Midjourney, and others)
  • Video generation services (Veo 3, Sora, and others)
  • Image upscaling and enhancement tools
  • Other AI-powered creative tools as we develop and integrate them

Service Evolution:

  • AI services and capabilities are subject to change without notice
  • We may add, remove, or modify AI providers at our discretion
  • No guarantees are made regarding availability of specific AI models or features

2.3 What FastRender.ai Does NOT Provide

  • Professional architectural advice or consultation
  • Guarantee of specific render quality, accuracy, or results
  • Real-time customer support (response time: up to 7 days)
  • Technical support for third-party software (e.g., Rhino 3D)
  • Liability coverage for your use of generated content

3. Eligibility and Account Requirements

3.1 Age and Capacity

Minimum Requirements:

  • You must have the legal capacity to enter into binding contracts in your jurisdiction
  • While we do not set a specific minimum age, users should typically be 18 years or older
  • If you are under 18, you represent that you have parental or guardian consent

Prohibited Users:

  • Individuals or entities previously banned from our Service
  • Persons located in countries subject to US embargo or sanctions
  • Individuals on US Treasury Department's list of Specially Designated Nationals

3.2 Account Registration

Account Creation:

  • You must provide accurate, current, and complete information during registration
  • You must maintain and update your account information
  • Email address must be valid and accessible to you
  • Company name (if provided) must be accurate

Authentication Methods:

  • Email and password authentication
  • Google OAuth sign-in
  • You are responsible for maintaining the confidentiality of your login credentials

Account Security:

  • You are solely responsible for all activities under your account
  • Notify us immediately at hello@fastrender.ai of any unauthorized access or security breach
  • We are not liable for losses resulting from unauthorized use of your account
  • You may not share your account credentials with others

3.3 Account Restrictions

One Account Per User:

  • Each user may maintain only one active account
  • Creating multiple accounts to circumvent subscription limits or restrictions is prohibited
  • We reserve the right to merge or terminate duplicate accounts

4. Subscription Plans and Billing

4.1 Subscription Tiers

Free Plan:

  • 20 credits per month
  • Access to basic features
  • No payment required
  • Subject to usage limits and restrictions

Pro Plan:

  • Monthly subscription: $29/month
  • 400 credits per month included
  • Metered billing for additional usage beyond included credits
  • Access to advanced features (Studio, premium AI models)
  • Billing handled through Stripe

Plan Features:

  • Specific features and limits are described on our pricing page
  • Features are subject to change without notice
  • We do NOT provide refunds for downgraded features

4.2 Metered Usage and Overage Charges

Pro Plan Metered Billing:

  • After using 400 included images, you can enable metered billing
  • Base Image Generation: $0.06 per additional image
  • Premium Features: Different pricing for video generation, upscaling, and other advanced features (rates displayed in-app)
  • Usage is tracked on a monthly basis
  • Monthly credits reset on your billing anniversary date

Billing Transparency:

  • You can view your current usage in your account dashboard
  • You will receive notifications as you approach usage limits
  • Metered charges are billed at the end of each billing cycle

4.3 Payment Processing

Stripe Integration:

  • All payments are processed securely through Stripe
  • We do NOT store your payment information
  • You must comply with Stripe's Terms of Service
  • By providing payment information, you authorize Stripe to charge your payment method

Billing Cycle:

  • Monthly subscriptions are billed on a recurring basis
  • Charges occur on the same day each month (your billing anniversary)
  • Metered usage charges are added to your monthly subscription fee

Failed Payments:

  • If payment fails, Stripe will attempt automatic retries
  • After multiple failed attempts, your subscription will be automatically canceled
  • You are responsible for ensuring valid payment information is on file
  • We are not liable for service interruption due to payment failures

4.4 Refund Policy

NO REFUNDS:

All payments are final and non-refundable. We do NOT provide refunds for:

  • Partial months of service
  • Unused credits or renders
  • Dissatisfaction with AI-generated results
  • Service interruptions or downtime
  • Account termination or suspension
  • Changes to features or pricing

Cancellation:

  • You may cancel your subscription at any time through your account settings
  • Cancellation is effective at the end of your current billing period
  • You retain access to paid features until the end of the billing period
  • No prorated refunds for early cancellation

4.5 Price Changes

Right to Modify Pricing:

  • We reserve the right to change subscription prices and fees at any time
  • Price changes will be communicated via email at least 30 days in advance
  • New prices apply to renewals after the notice period
  • If you do not agree to price changes, cancel your subscription before renewal

4.6 Taxes

User Responsibility:

  • You are responsible for all applicable taxes, duties, and governmental charges
  • Prices do not include sales tax, VAT, GST, or other local taxes
  • Taxes will be added to your invoice where legally required
  • You are responsible for providing valid tax exemption certificates if applicable

5. User Responsibilities and Acceptable Use

5.1 Your Responsibilities

YOU ARE SOLELY RESPONSIBLE FOR:

  1. Content You Upload:
    • All 3D model snapshots, reference images, and text prompts
    • Ensuring you have all necessary rights, licenses, and permissions
    • Compliance with copyright, trademark, and intellectual property laws
    • Accuracy and legality of all information you provide
  2. Use of Generated Content:
    • Verifying the accuracy and suitability of AI-generated renders
    • Obtaining necessary professional review before commercial use
    • Compliance with building codes, regulations, and industry standards
    • Any damages resulting from reliance on AI-generated content
  3. Legal Compliance:
    • Compliance with all applicable local, state, national, and international laws
    • Obtaining necessary consents for use of people's images or likenesses
    • Respecting intellectual property rights of third parties
    • Adhering to professional ethics and industry standards

5.2 Acceptable Use

You Agree To:

  • Use FastRender.ai only for lawful purposes
  • Provide accurate, truthful, and complete information
  • Respect the intellectual property rights of others
  • Use the Service in accordance with all applicable laws and regulations
  • Maintain the security and confidentiality of your account

6. Prohibited Content and Activities

6.1 Strictly Prohibited Content

YOU MAY NOT Upload, Generate, or Use Our Service to Create:

  1. Illegal Content: CSAM, content violating laws, or facilitating illegal activities
  2. Harmful and Dangerous Content: Violence, terrorism, weapons instructions, or self-harm content
  3. Hate Speech and Discrimination: Content promoting hatred or discrimination
  4. Non-Consensual Content: Deepfakes, non-consensual images, or privacy violations
  5. Sexual and Adult Content: NSFW content, pornography, or nudity
  6. Misleading and Fraudulent Content: Deceptive, phishing, or misinformation content
  7. Harassment and Bullying: Content intended to harass or intimidate
  8. Intellectual Property Violations: Infringing copyrights or trademarks
  9. Spam and Malicious Content: Spam, malware, or malicious code

6.2 Prohibited Activities

YOU MAY NOT:

  • Attempt unauthorized access to our systems
  • Use automated scripts or bots
  • Reverse engineer our software
  • Interfere with or disrupt the Service
  • Impersonate any person or entity
  • Resell or redistribute our Service

6.3 Content Moderation

We reserve the right (but have NO obligation) to monitor and remove content that violates these Terms. We are NOT responsible for content uploaded by users.

7. Intellectual Property Rights

7.1 Our Intellectual Property

FastRender.ai, including the website, web application, Rhino plugin, design, text, graphics, logos, interfaces, code, and all other elements, is owned by FreeForge LLC and protected by United States and international intellectual property laws.

7.2 License to Use Our Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use FastRender.ai for your personal or business purposes, conditioned on your compliance with these Terms.

8. User Content and License

8.1 Your Ownership of User Content

You retain all ownership rights to your User Content (3D model snapshots, reference images, text prompts). We do NOT claim ownership of your User Content.

8.2 License You Grant to Us

By uploading User Content, you grant FreeForge LLC a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit, and send your content to third-party AI services solely for providing our Service.

8.3 AI Training (Future Use)

We do NOT currently use your data to train AI models. In the future, if we implement AI training, you will have clear opt-out mechanisms and will be notified in advance.

8.4 Ownership of AI-Generated Content

You own all intellectual property rights to the renders generated by our AI using your inputs. You may use generated renders for commercial purposes without attribution requirements.

9. AI-Generated Content and Disclaimers

9.1 Nature of AI Technology

Artificial intelligence is an evolving technology with inherent limitations. AI-generated content is probabilistic and may not always be accurate, realistic, or appropriate. We do NOT guarantee quality, accuracy, or suitability of AI-generated renders.

9.2 AI Output Disclaimer

YOU ACKNOWLEDGE AND AGREE:

  • AI-generated renders may not accurately represent architectural feasibility or structural integrity
  • Renders are artistic representations and should NOT be relied upon for engineering or construction
  • AI may generate unexpected or unintended content
  • YOU are responsible for ensuring generated content does not infringe third-party rights
  • You must obtain professional review before using renders for construction or regulatory approval

10. Third-Party Services

10.1 Reliance on Third Parties

FastRender.ai relies on numerous third-party service providers including Google Gemini API, AWS, Stripe, and others. We do NOT control third-party services and are NOT responsible for their actions, availability, or policies.

10.2 No Liability for Third-Party Issues

We are NOT liable for third-party service outages, data breaches, or changes to third-party terms. You accept the risks inherent in using cloud-based, API-dependent services.

11. Service Availability and Modifications

11.1 No Uptime Guarantee

We do NOT guarantee continuous, uninterrupted, or error-free access to FastRender.ai. The Service may experience downtime, outages, or performance issues.

11.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or compensation.

12. Limitation of Liability

12.1 Maximum Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW:

Our total aggregate liability for any and all claims SHALL NOT EXCEED the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. If you are a Free Plan user, our maximum liability is limited to $50 USD.

12.2 Exclusion of Damages

We are NOT liable for indirect, incidental, consequential, or punitive damages, lost profits, data loss, or any damages arising from your use of the Service, AI-generated content, or third-party services.

12.3 Small Team Disclaimer

We are a small team without dedicated legal, security, or compliance departments. We do NOT have 24/7 support, regular security audits, or formal incident response procedures. By using FastRender.ai, you acknowledge and accept these limitations.

13. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS:

FreeForge LLC, its officers, directors, employees, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service or violation of these Terms
  • Your User Content or AI-generated content
  • Infringement of intellectual property rights
  • Your professional use or reliance on AI-generated renders
  • Third-party claims arising from your actions

14. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, FASTRENDER.AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do NOT warrant that the Service will be error-free, secure, or that AI-generated content will be accurate or suitable for any purpose.

15. Termination

15.1 Termination by You

You may cancel your subscription or delete your account at any time. Cancellation is effective at the end of your billing period with no refunds for early cancellation.

15.2 Termination by Us

We may terminate or suspend your account immediately without notice for violation of these Terms, uploading prohibited content, illegal activities, or at our sole discretion.

15.3 Effect of Termination

Upon termination, your access is revoked, all data may be deleted, and outstanding fees become immediately due. No refunds are provided upon termination.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before initiating arbitration, you must contact us at hello@fastrender.ai to attempt informal resolution within 60 days.

16.2 Binding Arbitration

YOU AND FREEFORGE LLC AGREE TO RESOLVE ALL DISPUTES THROUGH BINDING ARBITRATION, NOT IN COURT.

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules in Wyoming, United States.

16.3 Class Action Waiver

YOU AND FREEFORGE LLC AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN CLASS ACTIONS.

All disputes must be brought on an individual basis only.

16.4 Opt-Out Right

You may opt-out of this arbitration agreement within 30 days by emailing hello@fastrender.ai with subject "Arbitration Opt-Out".

17. Governing Law

These Terms are governed by the laws of the State of Wyoming and federal laws of the United States, without regard to conflict of law principles. You agree to the exclusive jurisdiction of courts located in Wyoming, United States.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FreeForge LLC.

18.2 Severability

If any provision is found invalid, it will be limited to the minimum extent necessary, and remaining provisions remain in effect.

18.3 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any affiliate or successor.

18.4 Notices

All notices to us must be sent to hello@fastrender.ai. We may provide notices via email to your registered email address.

BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR USING FASTRENDER.AI, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms of Service
  2. You agree to be bound by these Terms
  3. You understand the limitations of liability and disclaimers
  4. You accept that you are solely responsible for your use of the Service
  5. You agree to the arbitration and class action waiver provisions
  6. You understand that we are a small team with limited resources
  7. You accept all risks associated with using AI-generated content
